1. Who is responsible

Nine Digital is a brand of Olive Marketing Solutions Pvt. Ltd., 8219, Sector-B, Pocket-11, Vasant Kunj, New Delhi, Delhi 110070, India (phone +91 83684 06849). We are the data fiduciary under India’s Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the controller under the EU and UK GDPR for the personal data described here. This policy covers ninedigital.co, the free trial, the bot desk and our services.

2. What we collect

  • Trial and contact details: name, company, work email, business type and market.
  • Plan details: the services you select, billing term and quotes.
  • Service records: work items prepared for you, approvals, and messages we send you.
  • Paid engagements: billing details, the brief, and account access you choose to grant (for example a Meta or Google ad account). Card and bank details are entered on the payment gateway’s page, not on our site.
  • Technical data: basic server logs (IP address, browser, pages requested) kept by our hosting provider for security.

The plan builder also keeps your selections in your browser’s local storage so they are there when you return. We do not use analytics or advertising cookies.

3. Why we use it and our legal basis

  • To run your trial and provide services – your consent when you sign up (DPDP Act) and steps to enter into or perform a contract (GDPR).
  • To send trial updates and talk to you about a plan – your consent / our legitimate interest in following up a request you made.
  • Billing, tax and accounting – compliance with legal obligations.
  • Security and fraud prevention – legitimate uses permitted by law / legitimate interests.

We do not sell personal data, and we do not use client materials to train public AI models. You can withdraw consent at any time; this does not affect processing already done.

4. Who processes data for us

  • Vercel Inc. – website hosting.
  • Neon (Databricks) – database hosting for trial and service records.
  • Email provider – to send service emails (we will name it here once in use).
  • Payment gateways – Razorpay (India) and Stripe (elsewhere) for paid plans (named here once live).

They act on our instructions under data processing terms. We share data with authorities only where the law requires it.

5. International transfers

Our processors may store data outside India, including in the United States and the EU. We transfer data only to countries not restricted under the DPDP Act and, for EU/UK data, rely on adequacy decisions or Standard Contractual Clauses offered by those providers.

6. How long we keep it

  • Trial records that do not become a paid plan: deleted within 12 months of the trial ending, or sooner on request.
  • Client records: for the engagement, then as long as needed for legal claims.
  • Invoices and accounting records: for the period Indian tax law requires (currently up to 8 years).
  • Server logs: according to our hosting provider’s standard retention.

7. Your rights

Under the DPDP Act you can ask for a summary of your data and its processing, correction, completion, updating or erasure, grievance redressal, and nominate someone to exercise your rights. Under the GDPR you can also ask for access, rectification, erasure, restriction, portability, and object to processing. You may complain to the Data Protection Board of India or, in the EU/UK, your local supervisory authority.
